Gtrans.net is an electronic freight exchange, hosted at www.gtrans.net. Gtrans.net stays for Global Transport Netwok. Its aim is to facilitate the communication between companies proposing loads for transport and companies, proposing transport.

Visitor according to these terms and conditions is any physical or legal person browsing, opening pages or looking at any internet page or its Content in www.gtrans.net

Member according to these terms and conditions is in general a legal person (can be exceptionally be a physical person), who passed trough registering procedure and have full access to the Services provided by Gtrans.net.

User according to these terms and conditions is any employee of a Member.

Administrator according to these terms and conditions is the team, who conceived, created and is currently administrating the freight exchange activities and Services. 

Advertiser according to these terms and conditions is any physical or legal person who has put an advertisement in www.gtrans.net with the agreement of Administrator. Advertisement can be any information, provided by this physical or legal person.

Account according to these terms and conditions is a combination of username and password to access specific areas of the Site

Site by means of these terms and conditions is the totality of the Content at www.gtrans.net.

Services by means of these terms and conditions are the totality of services, including but not only posting and viewing offers, forum, bulletin, internal communication, provided at www.gtrans.net.

A legal person, who is a Member can have unlimited number of Users. In case a legal person has more than one offices, it is suggested, that each office is registered separately. In this case all offices of the Member are considered as one and the first registered Member gives the confirmation for all other offices.

Any Visitor, Member or User agrees to these terms and conditions by browsing, opening pages or looking at any internet pages or its content in www.gtrans.net.

Registration

Any Visitor, who is a legal person or its representative can become a member by submitting a registration request. An Administrator will contact you in order to give you feedback. Any Visitor filling the registration request confirms and warrant that he:
- is authorized to make the registration
- had red and agrees with the terms and conditions of usage of www.gtrans.net.
- is providing correct information, filled in this registration form and is not trying to mislead or misinform the Administrators.

Gtrans.net is bound not to provide the information from the registration form to any third party.

When a Visitor wants to become a Member additional information about the legal person is required. This information is provided by the Visitor at will and in case of refusal the registration process is not completed and the Visitor doesn't become a Member. Gtrans.net is bound not to provide the information to any third party.

Content

Content according to these terms and conditions is any internet page, software, databases, graphical elements and bitmap are property of Gtrans.net or/and its partners or subcontractors. Visitors or Member are not allowed to sell, distribute, give or diffuse the Content partially or in total to third parties in electronic, paper or any other media without the written approval of Gtrans.net.

By providing you an Account, Gtrans.net grants you personally and individually, a non-transferable, non-exclusive, non-sublicensable, limited license, permitting access only for the use of immediately electronically displaying Content retrieved from this Site.

The Visitors, Users or Members are not allowed to use the Content or the Services for marketing purposes, promotional purposes or any other activity that is out of the scope of the freight exchange.

You agree to indemnify Gtrans.net and our employees, directors and agents fully and effectively against any claim, costs or demand, including legal fees, made by any third party due to or arising out of your breach of this User Agreement.

You agree, that in no circumstances Gtrans.net will be liable for any breach by a Member of its contractual obligations to another Member or in respect of any claim by a Member against another Member for any reason.

You agree, that in no circumstance Gtrans.net will be liable for any breach for the information, provided in the content.

You agree, that Gtrans.net can delete any information from the Content, upon Administrator's judgment.

All Users agree to publish information only in English or Bulgarian language. Any information, published in other languages will be deleted. Possibility to use other languages will be available in near future.

Visitor, Members and Users

In order to avoid anonymous usage, each Member agrees, that the VAT number (VIES number) of the legal person will be visible for any other Member or User in the Site. In case VAT/ VIES numebr is not applicable in your country the Member has to provide a unique identifier of the legal person and agrees, that this unique identifier will be visible to all Members and/or Users.

Each Member has one or more Accounts, one for each User. The username and password are unique. The Member and the User are bound to keep in secret information about their username and password and not to provide to any other Visitor, Member, User or any third party.

Logging according to these terms and conditions means the process of correct input of the username and password in the corresponding fields.

After Logging, the User is identified by his real name.

All Visitors, Members or Users are bound not to perform any activity, that can harm, destroy or damage the Content of the Site.

All Visitors, Members or Users are bound not to diffuse any information containing offensive, slanderous, threatening or obscene parts. If such acts are detected, the Administrators can temporarily or permanently remove the Member or User Account.

Gtrans.net is allowed to propose and give promotional conditions of Services access to any Member or User of his choice, without a prior notifiation.

Liabilities

Members and Users are liable for the information, they provide or publish in the Site.

Users shall not upload, post or otherwise make available on the Site any material protected by copyright, trademark or other proprietary right without the express permission of the owner of the copyright, trademark or other proprietary right and the burden of determining that any material is not protected by copyright rests with User. User shall be solely liable for any damage resulting from any infringement of copyrights, proprietary rights, or any other harm resulting from such a submission. By submitting material to any public area of Site, User automatically grants, or warrants that the owner of such material has expressly granted him or his company the royalty-free, perpetual, irrevocable, non-exclusive right and license to use, reproduce, modify, adapt, publish, translate and distribute such material (in whole or in part) worldwide and/or to incorporate it in other works in any form, media or technology now known or hereafter developed for the full term of any copyright that may exist in such material. User also permits any other User to access, view, store or to reproduce the material for that User's personal use. User hereby grants Gtrans.net the right to edit, copy, publish and distribute any material made available on the Site by User.

Neither Gtrans.net nor any of our employees, directors, or agents give any guarantee that our Services and access to them will be continuous, uninterrupted or secure nor that the operation of the Site will not be interfered with by circumstances outside our control. The Site and our Services are provided “as is” and as and when available, and to the extent permissible by law we and they exclude all implied warranties, conditions or other terms, whether implied by statute or otherwise, including without limitation any terms as to skill and care or timeliness of performance.

Neither Gtrans.net nor any of our employees, directors, or agents will be liable for any economic losses (including without limitation, loss of revenues, profits, contracts, business or anticipated savings), any loss of goodwill or reputation, or any special indirect or consequential damages (however arising, including negligence) arising out of or in connection with our Services or the Site.

These terms and conditions shall be governed by and construed in accordance with Bulgarian Law and subject to the exclusive jurisdiction of the Bulgarian Courts.

Miscellaneous

Gtrans.net is allowed to change these terms and conditions without a prior notice.
